Emm AI - Terms of Service

1. Acceptance of Terms

By accessing and using the Emm AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms are governed by Norwegian law, and any disputes shall be resolved under the jurisdiction of Norwegian courts.

2. Service Description

Emm AI provides mission-control services for AI agents — durable personal memory, standing instructions, and an output wiki — accessible through the Model Context Protocol (MCP). The Service allows you to store, organize, and retrieve personal information, configure how your AI agents behave, and review artefacts they produce through AI agent integrations.

3. Service Tiers

3.1 Free Trial (1 month)

Full functionality for 1 month at no cost
Unlimited memory storage
Access to all MCP tools (search, save, update, delete)
AI agent integrations (ChatGPT, Claude, Cursor, etc.)
CSV import and export
AI prompts and anonymized service logs may be used to improve the Service
No guaranteed uptime or support response times

3.2 Premium Tier (USD 9.95/month or USD 99/year on the web; App Store pricing as shown at purchase for iOS in-app purchases)

Unlimited memory storage
All features from the free trial
No use of your data for service improvement
Priority support response
Enhanced data export options

4. User Accounts and Authentication

4.1 You must authenticate using a valid Google, GitHub, or Apple account (Sign in with Apple).

4.2 You are responsible for maintaining the security of your authentication credentials.

4.3 Each user may maintain one account per email address.

5. Acceptable Use

You agree not to:

Store illegal, harmful, or infringing content
Attempt to circumvent storage limits or security measures
Use the Service for automated bulk data processing
Share access credentials with others
Use the Service in violation of applicable laws

6. Data and Privacy

6.1 Your memories are stored in AWS DynamoDB in the EU (eu-central-1) with daily backups going back 35 days.

6.2 Sign-in is by Google, GitHub, or Apple; the service stores no password for those accounts. Demo accounts used for app-store review and support use a hashed password.

6.3 Free tier: AI prompts and anonymized service logs may be analyzed to improve the Service.

6.4 Premium tier: Your AI prompts and service logs are not used for service improvement. Diagnostic server logs are retained for 30 days on every tier, regardless of plan, for troubleshooting.

7. Intellectual Property

7.1 You retain all rights to the content you store.

7.2 By using the Service, you grant us a limited license to store and process your content as necessary to provide the Service.

7.3 The Emm AI software (and the underlying ActingWeb framework it is built on) are provided under open-source licenses where applicable.

8. Service Availability and Modifications

8.1 We strive to maintain Service availability but do not guarantee uninterrupted access.

8.2 We may modify, suspend, or discontinue the Service with reasonable notice.

8.3 Free tier services may be modified or discontinued at any time.

8.4 Service Fees may change with reasonable notice to reflect Service costs or Service value.

9. Limitation of Liability

9.1 The Service is provided "as is" without warranties of any kind.

9.2 We are not liable for data loss, service interruptions, or damages arising from use of the Service.

9.3 Our total liability is limited to the amount you have paid for the Service in the past 12 months.

10. Termination

10.1 You may terminate your account at any time through the Service interface.

10.2 We may terminate accounts that violate these Terms.

10.3 Upon termination, your account and data are removed from the live service immediately; residual copies in encrypted backups are purged within 35 days as backups rotate.

11. Changes to Terms

We may update these Terms with notice via the Service or email. Continued use after changes constitutes acceptance.
